Terms of Service

Article 1 — Definitions
"Platform": means the online service AgentPlugged accessible at agentplugged.ai, enabling the generation, testing, deployment, hosting and monitoring of AI agents.
"Publisher": means the company operating the Platform, as identified in the Legal Notice.
"User": means any natural or legal person registered on the Platform.
"AI Agent": means an autonomous computer program created, configured and deployed by the User via the Platform, using language models and tools (skills) to execute tasks.
"Skills": means the functional modules (tools, connectors, integrations) available on the Platform, enabling the extension of AI Agents capabilities.
"Sandbox": means the secure testing environment allowing the User to test their AI Agents before production deployment.
"Services": means all features offered by the Platform, including generation, sandboxing, deployment, hosting and monitoring of AI Agents.
Article 2 — Purpose and Acceptance
These Terms of Service govern access to and use of the AgentPlugged Platform. Registration and use of the Platform imply full and unconditional acceptance of these Terms.
The Publisher reserves the right to modify these Terms at any time. Users will be notified by email and/or notification on the Platform at least 30 days before changes take effect. Continued use constitutes acceptance of the new terms.
Article 3 — Registration and User Account
3.1 Registration requirements
Registration is open to any adult natural person (minimum 18 years) or legal entity with legal capacity. The User agrees to provide accurate information and keep it up to date.
3.2 Credentials and security
The User is solely responsible for the confidentiality of their login credentials and API keys. Any activity carried out from their account is deemed to have been performed by them. In case of suspected unauthorized use, the User must immediately notify the Publisher.
3.3 Third-party API keys
The User may be required to provide API keys for third-party services (LLM models, external services). The Publisher stores these keys in encrypted form and only uses them for the execution of the User's AI Agents. The User remains responsible for compliance with the terms of use of the relevant third-party services.
Article 4 — Description of Services
4.1 Plans and features
The Platform offers several service tiers:
Free: limited access to basic features (generation and sandbox).
Pro (€19/month): deployment, included hosting, monitoring, access to premium models.
Max (€99/month): advanced features, unlimited agents, priority support, guaranteed SLA.
The detail of features per plan is available on the Platform's pricing page and may evolve. The Publisher commits not to reduce the features of a plan during an ongoing subscription period.
4.2 Agent lifecycle
The Platform covers the entire AI Agent lifecycle: generation from natural language instructions, testing in Sandbox environment, production deployment, managed hosting, and real-time monitoring (usage, costs, performance).
4.3 Integrations (n8n / OpenClaw)
The Platform is built on the OpenClaw framework and supports bidirectional integrations with n8n. Workflows created by the User through these integrations are solely their responsibility.
Article 5 — Pricing and Payment
5.1 Prices
Prices are stated in euros excluding taxes (VAT). Applicable VAT will be added at billing according to current legislation (20% for French clients, reverse charge for EU professional clients with a valid VAT number).
5.2 Billing and payment
Subscriptions are billed monthly, payable in advance. Payment is made by credit card via a secure payment provider. Invoices are available in the user account.
5.3 Late payment
In case of payment default, access to the Services may be suspended after a 15-day reminder period. Late payment penalties at the applicable legal rate as well as a flat-rate recovery fee of 40 euros may be applied in accordance with articles L.441-10 and D.441-5 of the Code de commerce.
Article 6 — Right of Withdrawal
Pursuant to article L.221-28 of the Code de la consommation, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium, where execution has begun with the consumer's consent.
However, for paid plans, the User has a 14-day withdrawal period from the date of subscription, provided no AI Agent has been deployed to production during that period.
Article 7 — Availability and SLA
7.1 Availability commitment
The Publisher endeavors to keep the Platform accessible 24/7, with a target availability of 99.5% per calendar month for paid plans (excluding scheduled maintenance).
7.2 Maintenance
The Publisher reserves the right to temporarily interrupt access for maintenance, updates or improvements. Scheduled maintenance will be communicated at least 48 hours in advance. Emergency maintenance (security, stability) may be performed without notice.
7.3 Compensation
In case of SLA breach in a given month, the Pro or Max User may receive a credit proportional to the downtime, capped at 30% of the monthly subscription amount. The request must be submitted within 30 days following the incident.
Article 8 — Acceptable Use
8.1 Permitted uses
The User agrees to use the Platform in accordance with its intended purpose and applicable laws. AI Agents must comply with the terms of use of the underlying LLM models.
8.2 Prohibited uses
The following are notably prohibited:
- a)Creating AI Agents intended to generate spam, harassment, disinformation, or any unlawful content;
- b)Using the Platform for fraudulent activities, identity theft, or circumventing security systems;
- c)Intentionally overloading the infrastructure (DDoS attacks, abusive scraping);
- d)Reselling or subletting access to the Platform without written authorization;
- e)Using AI Agents to collect personal data without a legal basis;
- f)Any use contrary to the European regulation on artificial intelligence (EU AI Act).
8.3 Sanctions
In case of violation, the Publisher reserves the right to suspend or terminate the User's account without notice or refund, without prejudice to any legal action.
Article 9 — Intellectual Property
9.1 Platform
The Platform, its source code, its interfaces, the OpenClaw framework, and the Skills developed by the Publisher are protected by intellectual property law. No license is granted to the User beyond the right of use within the scope of their subscription.
9.2 User content
The User retains all intellectual property rights over the AI Agents they create, the workflows they configure, and the data they process via the Platform.
The User grants the Publisher a limited, non-exclusive and revocable license to host and run their AI Agents for the sole purpose of providing the Services.
Article 10 — Liability
10.1 Publisher's liability
The Publisher commits to providing the Services with due care. Its liability is limited to direct and foreseeable damages, and shall not exceed the total amounts paid by the User during the last 12 months.
The Publisher is not responsible for the results produced by AI Agents, which depend on the User's configuration, third-party LLM models, and the data provided.
10.2 User's liability
The User is solely responsible for their use of the Platform and the AI Agents they deploy. They indemnify the Publisher against any third-party claim related to the use of their AI Agents.
The User is responsible for ensuring their AI Agents comply with GDPR, the EU AI Act, and any applicable regulation.
10.3 Force majeure
Neither party shall be held liable for delays or failures due to force majeure as defined by article 1218 du Code civil.
Article 11 — Personal Data
The processing of personal data is detailed in the Privacy Policy attached to these Terms. The Publisher acts as a data processor (within the meaning of article 28 of the GDPR) for data processed by the User's AI Agents, and as data controller for data related to user account management.
Article 12 — Term and Termination
12.1 Term
The subscription is entered into for an indefinite period with monthly billing. The free plan is accessible without commitment.
12.2 Termination by the User
The User may cancel their subscription at any time from their personal account. Cancellation takes effect at the end of the current billing period. No prorated refund will be issued.
12.3 Termination by the Publisher
The Publisher may terminate a User's account in case of material breach of these Terms, after formal notice remaining without effect for 15 days (except in cases of emergency or manifest violation).
12.4 Data portability
Upon termination, the User has 30 days to export their data (agent configurations, workflows, logs). After this period, data will be deleted in accordance with the Privacy Policy.
Article 13 — Mediation
Pursuant to articles L.612-1 et seq. of the Code de la consommation, in case of unresolved dispute, the consumer may resort free of charge to a consumer mediator.
The consumer mediator will be designated and communicated at a later date on this page.
Article 14 — Applicable Law and Jurisdiction
These Terms are governed by French law. In case of dispute between professionals, the courts of Paris shall have exclusive jurisdiction. In case of dispute with a consumer, they may bring proceedings before the courts of their place of residence.
